This course is aimed at assisting students to understand constitutional and administrative law principles. The course commences with an overview of the legal system with a focus on sources of law and it looks at the historical and jurisprudential developments in constitutional law in the Caribbean. The course then examines specific concepts and themes of constitutional and administrative law, including the Bill of Rights and fundamental freedoms, parliamentary versus constitutional supremacy, the rule of law, separation of powers and the branches of government, the independence of the judiciary, judicial review, natural justice and legitimate expectation. The course then looks at practical issues such as the constitutionality of the death penalty, homosexuality, the Caribbean Court of Justice versus the Privy Council and public remedies and claims for judicial review and constitutional redress.
